Texas Construction General Permit for Pollutant Discharge Set for Renewal

Changes on the Horizon for Texas Pollutant Discharge Elimination System Construction General Permit

The Texas Commission on Environmental Quality (TCEQ) has announced plans to issue a renewed version of the Texas Pollutant Discharge Elimination System (TPDES) Construction General Permit (CGP) TXR150000 March 5, 2023. The renewal of the TPDES CGP will have implications for ongoing construction projects that are presently operating under the 2018 permit and are at least one acre or more in size. The new permit will include updated provisions that will begin March 5, 2023, and contractors will have 90 days to update their current Stormwater Pollution Prevention Plans (SWPPPs) to comply with the updated provisions of the new TXR15 permit. For sites that are five acres or more in size, site managers will need to submit a Notice of Intent-Renewal (NOI-R) form to be able to discharge in accordance with the updated permit.

Failure to complete the necessary changes by June 3, 2023, will result in the expiration of the ability to discharge in compliance with the CGP. The TCEQ has published a comprehensive list of the changes that will be included in the 2023 CGP.
